This Liability Waiver and Acknowledgment (“Waiver”) is entered into by the undersigned (“Customer”) in connection with the pickup, disassembly, and removal of purchased items from premises associated with SELLTHISFORME.com (“Auction House”).
1. Acknowledgment of Professional Recommendation
The Customer acknowledges and agrees that: The Auction House has strongly advised the Customer to retain qualified, licensed, and insured professionals to perform any disassembly, dismantling, loading, or removal of purchased items. The Auction House has advised the Customer to ensure that they, or any contractors they engage, maintain appropriate liability insurance, including coverage for personal injury and property damage.
The Customer voluntarily chooses whether or not to follow this advice and accepts full responsibility for that decision.
2. Assumption of Risk
The Customer understands that picking up, disassembling, and removing items on-site may involve inherent risks, including but not limited to: Personal injury or death, Damage to property, equipment, or structures, Injury to third parties, Equipment failure or misuse
The Customer knowingly and voluntarily assumes all risks, whether foreseen or unforeseen, associated with these activities.
3. Responsibility for Contractors and Assistants
The Customer is solely responsible for the actions and omissions of: Any employees,Contractors, Helpers, Agents or representatives engaged by the Customer in connection with pickup, disassembly, or removal activities.
4. Release and Waiver of Liability
To the fullest extent permitted by law, the Customer hereby releases, waives, and discharges SELLTHISFORME.com, its owners, officers, employees, agents, landlords, and affiliates from any and all claims, liabilities, damages, losses, costs, or expenses arising out of or related to: On-site disassembly, Pickup and removal activities, Failure to hire professionals, Failure to maintain insurance
This release applies whether such claims arise from negligence or otherwise, except where prohibited by law.
5. Indemnification
The Customer agrees to defend, indemnify, and hold harmless the Auction House from any claims, demands, damages, or legal costs (including attorneys’ fees) arising from the Customer’s actions or the actions of anyone acting on the Customer’s behalf.
6. Compliance with Rules and Instructions
The Customer agrees to follow all posted rules, verbal instructions, safety requirements, and timelines provided by the Auction House or site management.
7. Governing Law
This Waiver shall be governed by and construed in accordance with the laws of the Province of ONTARIO, CANADA
8. Acknowledgment and Signature
The Customer acknowledges that they have read, understood, and voluntarily agreed to this Waiver, and that they are legally bound by its terms.
